'In the context of developments at Community level, it is important for the Federal Ministry of Food, Agriculture and Consumer Protection, an overview of the effectiveness of to get at the national level, the available instruments of collective redress. They will also address any existing gaps are revealed in the system . It is necessary to examine whether and how such gaps can be closed at the national level a meaningful way.
Empirical part I.
The specific collective consumer protection mechanisms are to be investigated empirically in order to create a data base for evaluating the effectiveness of existing instruments.
o The following instruments are to be investigated empirically:
- Injunctions acc. § 1 UKlaG in general terms and conditions (AGB)
- Injunctions acc. § 2 UKlaG in violation of other consumer protection laws,
- In accordance with claim. § 8 UWG to eliminate unfair competition acts and omissions,
- Skimming claim acc. § 10 UWG
- Recovery action pursuant. § 79 paragraph 2 No. 3 Code of Civil Procedure and Article 1 § 3 No. 8 RBerG aF
